Desk Order Divorces

A desk order divorce is a process that allows you to obtain a divorce order without having to appear in front of a judge. If you are married, you need to get a formal divorce order to end your marriage legally. Although some couples choose to simply separate and not get divorced, if either of you wishes to remarry in the future, a divorce certificate will be required. 

The requirements of the court registry to obtain a divorce order can be complicated. Many clients find that having a lawyer file the required forms on their behalf at the various stages of the procedure is more effective and less stressful than trying to do it themselves. Your spouse will only need to cooperate in being served with the documents; no signature required.  

If you and your partner already have a separation agreement drafted, or have a final court order, then we can help you obtain an uncontested divorce. 

If you want to get a divorce in BC, you or your spouse must:

  • have been living in BC for 12 months before you apply;

  • have been separated for at least 12 months; and

  • still be living in BC when you apply

In order to start the process, we require an original of your marriage certificate (official translations are required in a particular form if it is in a language other than English).  

A flat fee rate, which includes all disbursements and court fees, is available. Additional costs may apply if your former spouse lives outside of Canada, there is difficulty serving your spouse or the application is rejected by the court and additional work is required.
